The loss of a family member is heart breaking and, in the midst of grief, it can also be fraught with hostility and conflict between the survivors over the Estate. Past grievances surface; favoritism of some over others; or perhaps some survivor holds the view that his/her efforts as caretakers of the deceased during his/her last years of life were not adequately recognized.
The most common conflicts in Estates arise out of:
- Whether the Last Will and Testament is valid;
- If there is no Last Will and Testament, distribution of Estate assets;
- Who is entitled as a beneficiary;
- What are the rights of a surviving spouse;
- Does the separated spouse have rights in the Estate;
- In the event of second marriages, what are the rights of children of the first marriage.
